1. Promoter

The promoter is Cherie Elizabeth McKay trading as The Nurtura Co, ABN 30 384 057 421 (the Promoter).

2. Promotion period

The Surprise Twins Promotion opens for eligible Nurtura VIP members at 12:00 am AEST on Monday, 28 September 2026 (the VIP Early Access Period).

The Promotion opens to the general public at 12:00 am AEST on Thursday, 1 October 2026 (the General Access Period) and closes for all entrants at 11:59 pm AEDT on Sunday, 1 November 2026 (together, the Promotion Period).

For these Terms & Conditions, a VIP member is a customer who is subscribed to the Nurtura VIP list and receives the Promoter’s VIP early-access invitation. During the VIP Early Access Period, the Promoter may verify VIP status using its subscriber records and the contact information supplied with the order.

Non-VIP orders placed before 12:00 am AEST on 1 October 2026 are not eligible for the VIP offer or Surprise Twins entry.

The Promoter may separately extend the Christmas sale or other promotional pricing beyond 1 November 2026. Any such sale extension does not extend the Surprise Twins Promotion. Orders placed after 11:59 pm AEDT on 1 November 2026 will not receive an entry into the Surprise Twins draw.

3. Eligibility

Entry is open to Australian residents who are 18 years of age or older, have an Australian delivery address and place an eligible order during the applicable access period.

During the VIP Early Access Period, entry is limited to eligible VIP members. From 12:00 am AEST on 1 October 2026, entry is open to all otherwise eligible entrants.

Persons under 18 years of age, international customers and orders with an international delivery address are not eligible for the Surprise Twins Promotion.

The Promoter, persons directly involved in conducting or determining the winner of the Promotion, and members of the Promoter’s immediate family are not eligible to enter.

Entrants must provide accurate contact and order information and must be able to verify their eligibility if requested.

4. How to enter

To enter, an eligible entrant must place an order containing at least one eligible Nurtura Baby through the Nurtura website during the applicable access period, apply the promotional code TWINMAS to that order at checkout and ensure payment is successfully received by the Promoter during that applicable access period. VIP early-access entrants must also satisfy the VIP-member requirement.

Orders with failed, declined, reversed or still-pending payment at the end of the Promotion Period are not eligible unless cleared funds were received by the Promoter before the Promotion closed.

Each qualifying order using TWINMAS receives one entry into the Surprise Twins draw, regardless of the number of Nurtura Babies included in that order. For example, an order containing three eligible Nurtura Babies using TWINMAS receives one entry, not three.

A customer who places more than one separate qualifying order using TWINMAS during the Promotion Period will receive one entry for each separate qualifying order.

Orders that do not use TWINMAS are not entered into the Surprise Twins draw and do not receive the 15% discount, even if they are placed during the Promotion Period.

TWINMAS must be entered and accepted at checkout and will not be applied retrospectively after an order is placed.

The Promoter will use qualifying WooCommerce orders carrying the TWINMAS code to create the final draw list. Each valid eligible order will be assigned one unique sequential draw number. The random draw will use those sequential draw numbers rather than customer details or publicly visible order information.

There is no additional fee to enter the Promotion beyond the normal purchase price of the eligible goods.

5. Eligible and invalid orders

All Nurtura Babies available for purchase from thenurturaco.com.au during the Promotion Period are eligible for the Promotion.

An order will not be eligible, or its entry will be removed before the draw, if the order is cancelled, fully refunded, fraudulent, unauthorised, unpaid, charged back, or otherwise determined not to be a genuine completed purchase.

Where an order is partially refunded but still contains at least one paid eligible Nurtura Baby, the order remains one eligible entry. A partial refund does not create an additional entry.

The Promoter may verify the validity of an order and entrant before awarding the prize.

6. Christmas promotional offer

During the VIP Early Access Period, eligible VIP members may receive 15% off eligible Nurtura Babies by applying the promotional code TWINMAS at checkout.

From 12:00 am AEST on 1 October 2026, the same offer is available to the general public, subject to these Terms & Conditions and the pricing displayed on the Nurtura website.

Use of TWINMAS during the Surprise Twins Promotion Period also identifies the order as a qualifying automatic entry into the Surprise Twins draw, provided all other eligibility requirements are met.

Free shipping is not included in the TWINMAS offer. Customers who separately subscribe as a VIP and hold a valid VIP free-shipping code may combine that code with TWINMAS on an eligible order, subject to the conditions of the VIP benefit.

The Christmas sale and the Surprise Twins Promotion are related campaign activities but have separate closing arrangements. The Surprise Twins Promotion closes permanently at 11:59 pm AEDT on 1 November 2026.

7. Prize

There is one Surprise Twins prize.

The winner may choose one Nurtura Baby of their choice with a regular retail value equal to or less than AUD $699, subject to availability and these Terms & Conditions.

The maximum total prize value is AUD $699, based on the Promoter’s regular retail pricing immediately before the Promotion.

The prize is intended to allow the winner to choose the Nurtura Baby they would most like as their Surprise Twin. The winner is not required to choose the same model, mould, gender, hair, skin tone or other characteristics as the Nurtura Baby originally purchased.

The prize is not transferable or exchangeable for cash, credit, gift card or another cash equivalent.

The prize is subject to product availability. If the winner’s selected Nurtura Baby becomes unavailable for reasons outside the Promoter’s reasonable control, the Promoter will work with the winner to select an alternative eligible Nurtura Baby of equal value where reasonably available, or otherwise deal with substitution in accordance with applicable law.

Standard Australian delivery of the prize will be provided by the Promoter at no additional cost to the winner.

8. Draw

The draw will take place at 12:00 pm AEDT on Monday, 2 November 2026 at Point Cook Library, 1–21 Cheetham Street, Point Cook VIC 3030 (the Draw Location).

After the Promotion closes, the Promoter will prepare a final list of valid eligible orders and assign one unique sequential draw number to each order. Each valid eligible order will have an equal chance of being selected.

The winner will be selected by applying a random number generator to the sequential draw numbers. Customer names, contact details and order numbers will not be entered into the randomiser.

The entrant does not need to be present at the draw.

The Promoter will retain an appropriate record of the eligible entry list and draw result in accordance with applicable trade-promotion record-keeping requirements.

9. Winner notification and announcement

The provisional winner will be contacted in writing using the email address and/or other contact details supplied with their order as soon as reasonably practicable after the draw and within any period required by applicable law.

The winner must confirm their eligibility and accept the prize within 14 days of written notification.

After the winner has been contacted and eligibility has been confirmed, the Promoter may publish the winner’s name and state, territory or general location on the Nurtura website and Nurtura social media channels.

The Promoter will not publish the winner’s street address or other unnecessary personal information. Any publication will be limited to what is reasonably necessary to announce and administer the Promotion and meet applicable legal publication requirements.

10. Unclaimed prize and redraw

The Promoter will make reasonable efforts to contact the provisional winner using the contact details associated with the winning order.

If the provisional winner cannot be contacted, does not respond and accept the prize within 14 days of written notification, is found to be ineligible, or otherwise cannot lawfully receive the prize, the prize may be forfeited, subject to applicable law.

If a redraw is required and legally permitted, it will be conducted at 12:00 pm AEDT on Monday, 16 November 2026 at the Draw Location, two weeks after the original draw.

The redraw will use the same sequential-number random selection method, excluding the original winning entry, and each remaining valid entry will have an equal chance of selection.

A replacement winner will be contacted, verified and announced in substantially the same manner as the original winner.

11. Prize fulfilment

The winner will be asked to nominate their preferred eligible Nurtura Baby after their eligibility and acceptance have been confirmed.

Availability may change between the date of the draw and the winner’s selection. The Promoter will confirm availability before the winner’s choice is finalised.

The Promoter will arrange preparation and delivery of the prize to an Australian address. Fulfilment timing may vary depending on whether the selected Nurtura Baby is in stock or is being prepared as part of an incoming stock order.

Nothing in these Terms & Conditions limits any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

12. Returns, cancellations and refunds

Participation in the Promotion does not exclude, restrict or modify any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

The Nurtura Refunds & Returns Policy continues to apply in addition to those statutory rights.

If an eligible order is cancelled, fully refunded, charged back or otherwise reversed before the draw, its Promotion entry becomes invalid and will be removed from the draw list.

If an order is partially refunded before the draw but still contains at least one fully paid eligible Nurtura Baby that the customer retains, the order remains one eligible entry. A partial refund does not create an additional entry.

A customer may request a return, remedy or refund in accordance with the Australian Consumer Law and the Nurtura Refunds & Returns Policy.

Exercising a lawful consumer right after the draw will not, by itself, cause a validly awarded prize to be withdrawn. However, the Promoter may investigate and disqualify an entry where the underlying order was fraudulent, unauthorised, not genuinely paid, deliberately manipulated to obtain an entry, or otherwise ineligible at the time of the draw.

Nothing in these Terms & Conditions requires a customer to give up a statutory consumer right because their order formed an entry into the Promotion.

13. Privacy

The Promoter will use personal information associated with eligible orders for purposes including administering the Promotion, validating entries, conducting the draw, contacting and verifying the winner, delivering the prize, maintaining required records and complying with applicable legal obligations.

Entry into the Surprise Twins Promotion does not, by itself, constitute consent to receive unrelated marketing communications. Marketing communications will continue to be managed in accordance with the customer’s existing preferences and applicable consent requirements.

Personal information will otherwise be handled in accordance with The Nurtura Co Privacy Policy and applicable law.

Where publication of winner information is required by law or reasonably necessary to administer and announce the Promotion, the Promoter may publish the information required for that purpose.

14. General conditions

The Promoter reserves the right to verify entries and entrants and to disqualify an entry that is not submitted in accordance with these Terms & Conditions or that involves fraud, manipulation, misuse of the ordering process or other conduct that undermines the fair operation of the Promotion.

If circumstances outside the Promoter’s reasonable control prevent the Promotion from being conducted as planned, the Promoter may take such steps as are reasonably necessary and permitted by law.

Where regulatory approval is required to amend, suspend or cancel the Promotion, the Promoter will obtain that approval before making the relevant change.

The Promoter’s decisions in relation to administration of the Promotion are final, subject always to applicable law.

The Promotion is governed by these Terms & Conditions and applicable Australian state, territory and Commonwealth laws.

These Terms & Conditions should be read with the:

• Website Terms of Use;
• Privacy Policy;
• Refunds & Returns Policy; and
• Shipping & Delivery Policy.

If any provision conflicts with a right or remedy that cannot lawfully be excluded, that right or remedy prevails.

15. Regulatory administration and records

The Promoter will complete any jurisdiction-specific administrative requirements applicable to the Promotion before it commences.

Because the Promotion is conducted electronically and is open to Western Australian residents, the final Terms & Conditions will be lodged with the relevant Western Australian regulator before commencement.

The Promoter will retain Promotion records, including the final entry list, draw evidence, winner notification and prize fulfilment records, for the periods required by applicable law.

Once the Promotion has commenced, changes requiring regulatory approval will not be made without that approval.
